These Terms & Conditions (“Terms”) govern your use of the website operated by BluPeak Ltd (“BluPeak”, “we”, “us”, “our”) at blupeak.online (the “Site”) and any purchases you make through the Site. “Buyer”, “you”, or “customer” means any person who purchases goods from the Site.
“Goods” means the products offered for sale on the Site.
“Contract” means the contract for the purchase of Goods between BluPeak and the Buyer, formed in accordance with these Terms.
All orders placed via the Site are subject to acceptance by BluPeak.
When you place an order, you will receive an automatic acknowledgement email confirming we have received your order. This acknowledgement does not constitute acceptance of your order.
A contract between you and BluPeak is formed when we send you a dispatch confirmation (email) confirming the Goods have been dispatched, unless we have previously accepted your order by email.
We reserve the right to refuse any order for any reason, including suspected fraud, incorrect pricing or stock unavailability.
Prices for Goods are shown on the Site and are quoted in the currency displayed on the product page. Prices include applicable taxes (unless otherwise stated) but exclude shipping, handling, customs duties and import taxes, which are the responsibility of the Buyer for international orders.
We may run promotions or discounts; such offers are subject to the terms published with the promotion and may be withdrawn at any time.
Payment must be received in full before we dispatch your order. We accept payments via the payment methods displayed on the Site (e.g., Stripe, Payoneer, Wise). All payment processing is handled securely by our payment providers; BluPeak does not store full card numbers on its servers.
You warrant that the card or account used to place the order is yours or that you are authorised to use it. If payment is refused by your card issuer or payment provider, we will not be obliged to provide the Goods and may cancel the order.
We attempt to ensure that all product descriptions, images, and prices are accurate. However, slight variations may occur. Colours may appear differently on different screens.
If a product is out of stock after you place an order, we will notify you and provide options (refund, alternative product, or backorder where available). We are not liable for delays caused by suppliers, carriers, or customs.
Processing time: Orders are typically processed within 1–3 business days unless otherwise stated.
Delivery estimates:
Domestic (UK): 2–7 business days (standard tracked).
International: 7–21 business days (may be longer depending on customs and destination).
These are estimates only and not guaranteed.
You are responsible for providing accurate delivery details. We are not liable for parcels lost due to incorrect addresses.
Customs, duties and import taxes for international deliveries are the responsibility of the Buyer and are not included in the purchase price.
If a parcel is returned to us due to incorrect address or refusal by customs, we will contact you. You will be responsible for re-shipping costs or you may request a refund net of outbound and return shipping charges.
If you wish to cancel an order, contact us immediately at contact@blupeak.online. Cancellation may be possible only prior to dispatch.
If your order has already been dispatched, please follow the Returns procedure after receiving the Goods.
Cancellation / Change of mind: You may return most items (in the same condition as supplied) within 30 days of delivery for a refund to the original payment method. Return shipping costs are generally the responsibility of the Buyer unless otherwise stated. Items marked as final sale or personalised cannot be returned unless faulty.
Faulty or incorrect items: If you receive a faulty or incorrect item you must notify us within 30 days of delivery. We will provide a prepaid return label where appropriate and will repair, replace, or refund the item at our discretion. Return shipping costs for faulty items will be covered by BluPeak.
Refund processing: Refunds are issued after we receive and inspect the returned Goods. Refunds will be made to the original payment method within 7–14 business days of receipt and inspection. Processing times may vary depending on banks/payment providers.
Exchanges: We will process exchanges subject to stock availability. If your requested replacement is out of stock, we will offer a refund or store credit.
Subject to applicable law, BluPeak’s liability for defective goods is limited to the purchase price of the defective item.
BluPeak does not exclude or limit liability for: (a) death or personal injury caused by its negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability which cannot be excluded by law.
To the fullest extent permitted by law, BluPeak shall not be liable for indirect or consequential losses, loss of profit, loss of business, or depletion of goodwill.
All content on the Site (including text, graphics, logos, product images, and designs) is owned or licensed by BluPeak and is protected by intellectual property laws.
You may not reproduce, distribute, modify, create derivative works, or publicly display any of the Site’s content without our prior written consent.
You agree not to:
Use the Site for any unlawful purpose;
Post or transmit any false, misleading or infringing content;
Interfere with the security of the Site;
Attempt to harvest user data or use robots or scrapers to extract information.
The Site may contain links to third-party websites or services. These links are provided for convenience and do not imply endorsement. We are not responsible for the content or practices of third-party sites.
Your use of third-party services (such as payment providers, shipping carriers, or marketplaces) is subject to those providers’ terms and policies.
Our use of your personal data is governed by our Privacy Policy. By using the Site, you consent to the processing described therein.
For KYC and payment processing we share necessary data with payment processors (e.g., Stripe, Wise, Payoneer) to fulfil orders and comply with legal obligations.
Where a pricing or description error occurs, we reserve the right to cancel orders affected by the error and refund any sums already paid. We will notify you if such a cancellation is necessary.
BluPeak will not be liable for any failure or delay in performing obligations caused by circumstances beyond its reasonable control (including acts of God, pandemics, strikes, governmental restrictions, supply chain disruptions, or carrier delays).
We reserve the right to suspend or terminate access to the Site, refuse service, or cancel orders at any time where necessary to protect the business, comply with legal requirements, or prevent fraud.
If you have a complaint, please contact our support team at contact@blupeak.online. We aim to acknowledge all complaints within 2 business days and resolve them quickly.
For disputes that cannot be resolved informally, the parties will attempt to resolve the dispute through mediation or other alternative dispute resolution before pursuing litigation.
These Terms are governed by and construed in accordance with the laws of United States. Subject to the provisions on dispute resolution above, the courts of England and Wales will have exclusive jurisdiction.
If any provision of these Terms is found to be invalid, illegal or unenforceable, the remaining provisions will continue in full force and effect.
These Terms and any documents expressly referred to in these Terms constitute the entire agreement between you and BluPeak in relation to their subject matter and supersede any prior statements or agreements.
